Application of the ninth edition of the International Classification of Goods and Services according to the Nice Agreement the International Classification of Goods and Services for the Purposes of Trademark Registration

On 19 December 2006, the NOIP issued Notification no. 2986/TB-SHTT on the application of the nineth edition of the International Classification of Goods and Services according to the Nice Agreement the International Classification of Goods and Services for the Purposes of Trademark Registration published by the WIPO.

Accordingly, since 1 January 2007, the NOIP has officially applied the nineth edition in stead of the eighth edition of the International Classification of Goods and Services. All trademark registration application filed to the NOIP since this day must have the classification of goods and/or services in compliance with the nineth edition (however, classification of goods and/or services as filed on applications before the date will not be re-classified)

There are some changes related to classes 14, 20, 21, 26, 34, 42 and 25 and small changes related to other classes i n this edition. Some main changes include: (i) Class 35: comprises of services provided at retail and wholesale shops or through order letter, electronic media; (ii) legal services in Class 42 in the eighth edition has been changed to Class 45; (iii) Class 45: legal services; services provided by lawyers to individuals, community, organisations and companies.
