|
The Vietnamese government deposited the instrument of accession to the Madrid Protocol on April 11 2006 with the director general of the World Intellectual Property Organization. The protocol came into force in Vietnam on July 11 2006. From July 11 2006 the Vietnamese trademark owners can obtain international registrations for their marks based on a Vietnamese application or registration. Similarly, foreign trademark owners will be able to obtain international registrations protectable in Vietnam based on applications or registrations in their home countries. In the instrument of accession, the government made the declaration referred to in Article 8(7) of the protocol, which requests for an individual fee when Vietnam is designated, either in an international application or in a designation subsequent to an international registration or in respect of the renewal of an international registration designating Vietnam (instead of a share in the revenue produced by the supplementary and complementary fees). The amounts of the individual fees for international application or subsequent designation will be Sfr155 for one class of goods and/or services and Sfr122 for each additional class. The individual fee for renewal of an international registration will be Sfr139 for one class of goods/services and Sfr122 for each additional class. Vietnam has been a party to the Madrid Agreement since March 8, 1949. Its accession to the Madrid Protocol brings the number of contracting parties to 68. The total number of contracting parties to the Madrid system remains 78. |
