INDUSTRIAL DESIGNS

An industrial design is the aesthetic aspect of a useful product, consisting of the shape and/or lines and/or colors. A Patent for Industrial Design shall be granted for an industrial design which is new, nonobvious and capable of serving as a pattern for a product of industry or handicraft. Protection is not available for the designs: (i) that serve solely to obtain a technical result; (ii) that of buildings; and (iii) that of products which are invisible when used.

Our firm’s design team, advised by Le Hoai Duong (he was former design examiner and Deputy Director of Industrial Designs & Trademarks Division of the NOIP), has extensive experience in evaluating states of the art, infringements and validities of design patents, resolving conflicts with design patentees or infringers, opposing/invalidating design patents, and appeals to the NOIP’s Board of Appeals or Ministry of Science and Technology.

Our firm has successfully represented clients in numerous landmark cases before the NOIP's Board of Appeals.
